These Terms and Conditions "Agreement" govern the booking of artists "Artist" or "Artists" through A’Live Experiences "Company" or "We" by any individual, organization, or event organizer "Client" or "You". By using our services, you agree to comply with and be bound by these terms. If you do not agree to these terms, please refrain from using our services.
1. Definitions
- Artist: Any performer, musician, entertainer, or individual booked through the Company.
- Client: Any person or entity using the Company's services to book an Artist.
- Event: The performance, function, or occasion where the Artist will be performing as booked by the Client.
2. Booking Process
1. Inquiries: All booking inquiries must be submitted through the official channels of the Company (website, email, phone, or in-person).
2. Confirmation: A booking is only confirmed once the Client receives written confirmation from the Company, accompanied by a booking contract outlining the Artist’s fees, performance details, and payment terms.
3. Deposit: A non-refundable deposit of 50% of the total booking fee is required upon confirmation to secure the Artist.
4. Full Payment: The remaining balance must be paid 30 before the Event unless otherwise agreed upon in writing.
3. Payment Terms
1. Payment Methods: Payments can be made via bank transfer, credit card, etc.
2. Late Payments: If payments are not made by the due date, the Company reserves the right to cancel the booking, retain any deposits paid, and charge additional fees for any administrative costs incurred.
3. Taxes: All fees are exclusive of applicable taxes, which shall be added and paid by the Client where applicable.
4. Cancellations and Refunds
1. Client Cancellations: If the Client cancels the booking:
- Cancellations made more than 30 days before the Event will result in a loss of the deposit.
- Cancellations made within 30 days of the Event will require the Client to pay 50% of the total booking fee.
2. Company Cancellations: The Company reserves the right to cancel the booking in the event of unforeseen circumstances (such as illness or unavailability of the Artist). In such cases, the Client will receive a full refund of any payments made. We will also work to find a suitable replacement Artist.
5. Rescheduling
1. If the Client wishes to reschedule the Event, they must inform the Company at least 45 Days in advance. Rescheduling is subject to the Artist’s availability and may incur additional fees.
6. Performance Details
1. Artist Requirements: The Client must provide any necessary equipment, facilities, or special requirements for the Artist (e.g., sound systems, stage, dressing rooms). These requirements will be outlined in the booking contract.
2. Event Timing: The Client must ensure the Event runs according to the agreed schedule. Any delay in the start of the performance due to Client's actions may incur additional fees for extended performance times.
3. Event Safety: The Client must ensure the safety of the Artist at all times during the Event. Any inappropriate behaviour or unsafe conditions may result in the Artist ending their performance early, with no refund given.
7. Intellectual Property
1. Rights: Any music, performances, or artistic work created by the Artist remains their intellectual property. The Client is not permitted to record, reproduce, or distribute the performance without prior written consent from the Company or the Artist.
2. Promotion: The Client agrees that the Company may use images, videos, or testimonials related to the Event for promotional purposes, unless otherwise agreed.
8. Liability
1. Artist Liability: The Company acts as an intermediary between the Artist and the Client. While we will do our best to ensure the quality of performances, the Company is not liable for the actions, performance, or behaviour of the Artist.
2. Event Liability: The Client agrees to indemnify and hold the Company harmless from any claims, damages, or liabilities arising from the Event, including but not limited to property damage, personal injury, or breach of contract.
9. Force Majeure
The Company will not be held responsible for any cancellations or delays due to circumstances beyond its control, including but not limited to natural disasters, government restrictions, pandemics, or strikes.
10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws. Any disputes arising under this Agreement shall be resolved in the courts of.
11. Modifications to Terms
The Company reserves the right to modify or amend these Terms and Conditions at any time. Clients will be notified of any significant changes.
